Employers should take note of a Case Study (Ref: 14/2013) recently issued by the Data Protection Commissioner, and which addresses the issue of data that should be protected in situations where new employees arrive in their new company. If such employees bring with them data on clients of their previous company, such data is protected and cannot be used by that new employer for marketing campaigns.
The precise wording from the Commissioner in his warning for employers states that ‘Data Controllers must be aware that where they process data which has been brought into the organisation by a new employee from their previous employment without the consent of the individuals, they are in breach of the Data Protection Acts’.
